Effective March 10, 1998, the federal 9th Circuit Court of Appeals determined the California Minority and Women Business Enterprise (M/WBE) Participation Program requirements contained in California Public Contract Code Section 10115, et seq., unconstitutional (see Minority/Women Business Enterprise Update). As a result Executive Order W-172-98 directs state agencies to cease enforcement of the minority and women business enterprise participation goals and the good faith effort requirements related to the law. Management Memo 98-04 further clarifies the Executive Order and assists state agency compliance.
This action applies to:
- State contracts administered under Public Contract Code Section 10115 et seq.
This action does not apply to state contracts:
- administered under other statutes
- which are federally-funded
Programs not impacted and remain in effect:
