Welcome to Procurement Division's site for Model Language. The model language to be used for all commodity and information technology contracts can be found by accessing this site.

****READ FOLLOWING LINK BEFORE USING MODEL CONTRACT LANGUAGE****
The DGS Procurement Division has authority for the statewide procurement of materials, supplies and equipment (commodities) and information technology goods and services (IT). This authority may be delegated to other state agencies with specific conditions of the delegation. All Procurement Division buyers and state agencies buying under delegation should use the standard contract formats established by the Procurement Division.

Bidder Instructions, Model Solicitation Documents, tell potential bidders how to provide a responsive bid to the State, but do not duplicate provisions that will be part of the resulting contract. When creating solicitations, buyers should use the standard form for Bidder Instructions and include any additional bidder instructions as a supplement, in order to tailor the instructions to the specific transaction.

Solicitations should also include a sample contract or contract provisions, including General Provisions, which bidders will review when determining how the contractual agreement between the parties will be structured. A Statement of Work, Model Solicitation Documents, should be included to complete the contract, and additional general or special provisions tailored for the specific transaction can be added.

General Provisions, Model Contract Language, should be included in all commodities and IT contracts  please refer to the Model Contract Language section for specifics.  Information Technology Modules, Model Contract Language, should be added to all IT contracts in excess of $500,000 (select the modules needed by transaction); they may also be used for contracts under $500,000.

By clicking on the Model Contract Language at the top of the page, you will be taken to a separate page to access General Provisions and Information Technology Contract Modules; click on Model Solicitation Documents, and you can access Bidder Instructions, Section II (Information Technology solicitations > $500,000), Statements of Work, and model solicitations (currently under development); click on STD213 or STD213WWW for the STANDARD AGREEMENT, and STD215 for the AGREEMENT/SUMMARY.

In accordance with the Federal Stimulus Recovery Act, Supplemental Terms and Conditions for the American Recovery and Reinvestment Act (ARRA) procurements are available here.

NOTE: As these documents are revised, new effective dates will be used; old versions will continue to be maintained since they continue to apply to those solicitations and contracts which used them.
