General Provisions: To be included in all commodities and IT contracts in excess of $5,000.
Required Clauses for transaction less than $5,000:
DGS/PD recommends that departments use the State's General Provisions on transactions valued less than $5,000. If departments elect not to include and/or reference the General Provisions, then the department is required to obtain written confirmation, prior to award, that the supplier will abide by the following required contract provisions:
- American with Disabilities Act (ADA)
- Non-discrimination and Statement of Compliance
- Drug-Free Workplace Certification
- Forced, Convict & Indentured Labor
- National Labor Relations Board Certification
Information Technology Modules: To be added to all IT contracts in excess of $100,000. You select the modules you need according to the goods and/or services being acquired. For instance, if you are procuring hardware maintenance only, you would need to include the following: Statement of Work, General Provisions, and the Information Technology Maintenance Special Provisions. If you are procuring hardware and maintenance, you would add to the above, the Information Technology Purchase Special Provisions.
Statements of Work: The Statement of Work defines the roles and responsibilities of the State and the Contractor. It is to include items such as Delivery and Installation, Acceptance Testing, Warranty terms in excess of those in the General Provisions, etc. Refer to the State Contracting Manual Vol II (SCM), Section 3.3.4, for further information on the development of the Statement of Work, available for viewing at our web site, under "Policies and Procedures".
Additionally, any user Special Provisions are to be included as an attachment to the contract.
