The DVBE incentive is required in solicitations that include the DVBE program requirement unless they are exempt in accordance with California Code of Regulations section 1896.99.100(a):
- For departments having met or exceeded the DVBE 3 percent goal for 2 out of the 3 previous years, their highest ranking executive officer or his/her designee may elect to exempt a solicitation from the DVBE incentive.
- The 3 most current published DGS annual reports are used to document a department's DVBE participation. Annual reports for prior years are located at the DGS Legislative Publications page.
The DGS maintains and updates lists of those departments eligible to exempt a solicitation from the DVBE incentive per regulations. The DGS supports the use of DVBEs whenever possible.
The current list is to be used for solicitations released or posted until a subsequent list is posted. All lists will be maintained on this website. As subsequent annual reports are published by the DGS, a new list will be created for solicitations released or posted after the published date of the latest annual report.
