RE: Protective Apparel Corporation of America (PACA) and Point Blank Body Armor (Point Blank) Notice of Class Action
To All Body Armor Users, Purchasers and Managers:
All State agencies that have purchased PACA/Point Blank body armor containing Zylon are to read the attached Notice of Class Action, Proposed Settlement and Hearing information and are to fill out the appropriate documents and submit them as instructed.
The settlement agreement provides that PACA and Point Blank offer replacement panels and either a voucher or a new standard carrier (please see Page 2; Section 7 "What does the settlement provide?"). These replacement items have not been evaluated or approved by the Department of General Services, Procurement Division.
If agencies have already purchased replacement vests, it may be in the State's best interest to opt out and file suit to replace funds that have been spent on the replacements. The Department of General Services strongly recommends that each agency speak to their management and legal department to determine what course of action they should take.
The action must be taken and all paperwork completed and postmarked no later than March 6, 2006. In addition, please notify Nicole Delgado at 916-375-4476 or Nicole.Delgado@dgs.ca.gov of your agency's decision. |
